Welcome to Capture and Cherish ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Capture and Cherish mobile application ("App") and related services (collectively, the "Service"). By downloading, accessing, or using our App, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our App.

1. Eligibility

You must be at least 18 years old or have permission from a parent or legal guardian to use this App. By using the App, you represent that you meet these requirements.

2. Use of the App

Capture and Cherish allows users to:

• Create personalised digital baby books and school memory books
• Upload photos and text
• Save and edit content
• Share or print completed books

You agree to use the App for lawful purposes only and not to misuse or attempt to exploit any part of the App.

3. User Content

You retain ownership of all content (photos, text, etc.) you upload to the App ("User Content"). By uploading content, you grant Capture and Cherish a non-exclusive, royalty-free license to use, display, and store your content solely for the purpose of providing the Service.

You are responsible for ensuring that:

• You own or have permission to use all content you upload
• The content does not infringe on the rights of others
• The content is not illegal, harmful, or offensive

We reserve the right to remove content that violates these Terms.

4. Account and Security

You may need to create an account to use certain features. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

Notify us immediately of any unauthorised use or security breach.

5. Payments and Subscriptions

Some features of the App may be free, while others require payment (e.g. printing books, premium templates). Prices and subscription terms will be disclosed in the App before purchase. All payments are processed securely through the App Store or Google Play.

Subscriptions may renew automatically unless cancelled. You can manage or cancel your subscription through your account settings in the App Store or Google Play.

6. Intellectual Property

All content in the App (excluding User Content) including text, graphics, logos, and software is owned or licensed by Capture and Cherish and is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

7. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or use the Service in a way that may cause harm to others or to our business.

8. Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or that it will meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, Capture and Cherish shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

10. Privacy

Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

11. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you in the App or via email. Continued use of the App after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.
